保健食品违法经营行为法律责任探究
近年来我国保健食品行业快速发展、市场不断扩大, 但同时暴露的问题也越来越多。保健食品虚假宣传的屡禁不止、保健食品冒充药品欺骗消费者、在涉及疾病治疗功能方面与药品相混淆、在保健食品中非法添加违禁药物等违法行为, 不仅侵害了消费者身心健康, 对整个保健食品产业都造成了负面影响。本文从刑事责任、行政责任、民事责任等方面分析了保健食品违法经营应承担的法律后果。对市场监管部门查处涉及保健食品违法经营案件、消费者维护自身权益、保健食品经营者规范经营行为, 具有一定的现实意义。
In recent years, China's health food industry has been developing rapidly and the market has been expanding, but at the same time, there are more and more problems exposed. Many illegal behaviors, such as false advertising of health food, false labeling of health food as medicine to deceive consumers, confusion with drugs in terms of disease treatment function and illegal addition of illicit drugs in health food, have not only harmed consumers' physical and mental health, but also caused negative impacts on the whole health food industry. This paper analyzed the legal consequences of the illegal management of health food from the aspects of criminal liability, administrative liability and civil liability. It was of certain practical significance to investigate and deal with cases involving the illegal operation of health food, to protect the rights and interests of consumers and to regulate the business practices of health food manager.
